## Key facts (EN)

- Since 27 September 2026, sellers must give consumers repairability information before purchase (Article 6(1)(u) and (v) of Directive 2011/83/EU, inserted by Directive (EU) 2024/825; in-store: Article 5(1)(i) and (j)). Germany implemented this in Art. 246a § 1 Abs. 1 Satz 1 Nr. 20 and 21 EGBGB.
- The rule has two steps: first the EU repairability score; where there is none, information on spare parts (availability, estimated cost, ordering procedure), repair and maintenance instructions and repair restrictions, only to the extent the producer makes it available to the seller.
- An EU repairability score exists since 20 June 2025 for smartphones and slate tablets: the repairability class A to E on the energy label, derived from an index from 1 to 5 (Regulation (EU) 2023/1669). Tumble dryers placed on the market from 1 January 2027 get a class too (Delegated Regulation (EU) 2025/1353).
- Sellers need not search manufacturer websites; information the producer gives on the product, packaging or label counts (recital 36 of Directive (EU) 2024/825).
- Whether the producer condition falls away when the seller is the manufacturer, own brand or importer is not settled.
- The information must be available before the order but need not be repeated right before the order button.
- The right to repair (Directive (EU) 2024/1799) is a separate rule: for sales contracts concluded from 31 July 2026, the seller’s liability period is extended once by 12 months when the consumer chooses repair, and the seller must say so beforehand.
- Spare parts duties under the ecodesign regulations apply to manufacturers, importers and authorised representatives, not sellers, and give consumers no claim of their own. For smartphones the period is seven years after the end of placing on the market (Regulation (EU) 2023/1670).
- The French indice de réparabilité is a national score (French Environmental Code), not an EU repairability score. It covers laptops, electric lawn mowers, dishwashers, vacuum cleaners and pressure washers; TVs and washing machines carry the indice de durabilité, smartphones no French index since 7 July 2025.
- The rule applies only to sales to consumers. It covers marketplace sellers and sellers outside the EU who direct their store at EU consumers.

- Seit dem 27. September 2026 müssen Onlineshops Verbrauchern vor dem Kauf Angaben zur Reparierbarkeit machen (Art. 246a § 1 Abs. 1 Satz 1 Nr. 20 und 21 EGBGB, Umsetzung der Richtlinie (EU) 2024/825 durch BGBl. 2026 I Nr. 28). Im Laden gilt dasselbe nach Art. 246 Abs. 1 Nr. 9 und 10 EGBGB.
- Die Pflicht hat zwei Stufen: erst der Reparierbarkeitswert der Union; gibt es keinen, Angaben zu Ersatzteilen (Verfügbarkeit, geschätzte Kosten, Bestellverfahren), Reparatur- und Wartungsanleitungen und Reparatureinschränkungen, diese nur, soweit der Hersteller sie dem Händler zur Verfügung stellt.
- Einen Reparierbarkeitswert der Union gibt es seit dem 20. Juni 2025 für Smartphones und Slate-Tablets: die Reparierbarkeitsklasse A bis E auf dem Energielabel, berechnet aus einem Index von 1 bis 5 (Verordnung (EU) 2023/1669). Für Wäschetrockner, die ab dem 1. Januar 2027 in Verkehr gebracht werden, kommt eine Klasse hinzu (Delegierte Verordnung (EU) 2025/1353).
- Händler müssen nicht auf Herstellerwebsites nach Angaben suchen; was der Hersteller auf Produkt, Verpackung oder Etikett angibt, zählt (Erwägungsgrund 36 der Richtlinie (EU) 2024/825).
- Ob die Herstellerbedingung entfällt, wenn der Händler selbst Hersteller, Eigenmarke oder Importeur ist, ist nicht entschieden.
- Die Angaben müssen vor der Bestellung bereitstehen, aber nicht unmittelbar vor dem Bestellknopf wiederholt werden; § 312j Abs. 2 BGB nennt Nr. 20 und 21 nicht.
- Das Recht auf Reparatur (Richtlinie (EU) 2024/1799) ist eine andere Regel: Für Kaufverträge ab dem 31. Juli 2026 verlängert sich die Verjährung bei Nachbesserung einmalig um zwölf Monate (§ 475e Abs. 5 BGB), darauf weist der Verkäufer vorher hin (§ 475 Abs. 4 BGB).
- Ersatzteilpflichten aus den Ökodesign-Verordnungen treffen Hersteller, Importeure und Bevollmächtigte, nicht Händler, und geben Verbrauchern keinen eigenen Anspruch. Bei Smartphones gelten sieben Jahre nach dem Ende des Inverkehrbringens (Verordnung (EU) 2023/1670).
- Der französische indice de réparabilité ist ein nationaler Wert (Code de l’environnement), kein Reparierbarkeitswert der Union. Er gilt für Laptops, elektrische Rasenmäher, Geschirrspüler, Staubsauger und Hochdruckreiniger; Fernseher und Waschmaschinen tragen den indice de durabilité, Smartphones seit dem 7. Juli 2025 keinen französischen Index.
- Die Pflicht besteht nur gegenüber Verbrauchern. Sie trifft auch Marktplatz-Verkäufer und Händler außerhalb der EU, die ihren Shop auf Verbraucher in der EU ausrichten.
- Geldbußen nach Art. 246e EGBGB kommen in Deutschland nur bei weitverbreiteten Verstößen im Rahmen einer koordinierten EU-Durchsetzung in Betracht; im Übrigen wird die Pflicht zivilrechtlich durchgesetzt (UWG, UKlaG).

- Depuis le 27 septembre 2026, le vendeur doit informer le consommateur sur la réparabilité avant l’achat (directive 2011/83/UE, article 6, paragraphe 1, points u) et v), ajoutés par la directive (UE) 2024/825 ; en magasin : article 5, paragraphe 1, points i) et j)).
- La règle a deux niveaux : d’abord l’indice de réparabilité de l’UE ; à défaut, les informations sur les pièces détachées (disponibilité, coût estimé, procédure de commande), les instructions de réparation et d’entretien et les restrictions de réparation, dans la mesure où le producteur les met à disposition du vendeur.
- Un indice de réparabilité de l’UE existe depuis le 20 juin 2025 pour les smartphones et tablettes : la classe de réparabilité de A à E sur l’étiquette énergétique, issue d’un indice de 1 à 5 (règlement (UE) 2023/1669). Les sèche-linge mis sur le marché à partir du 1er janvier 2027 auront aussi une classe (règlement délégué (UE) 2025/1353).
- Le vendeur n’a pas à chercher sur les sites des fabricants ; ce que le producteur indique sur le produit, l’emballage ou l’étiquette compte (considérant 36 de la directive (UE) 2024/825).
- L’indice de réparabilité français (Code de l’environnement) est un indice national, distinct de la classe de réparabilité de l’UE. Il concerne les ordinateurs portables, tondeuses électriques, lave-vaisselle, aspirateurs et nettoyeurs haute pression ; les téléviseurs et lave-linge relèvent de l’indice de durabilité, les smartphones d’aucun indice français depuis le 7 juillet 2025.
- En France, l’indice s’affiche près du prix, avec les paramètres accessibles ; l’amende administrative peut atteindre 3 000 € pour une personne physique et 15 000 € pour une personne morale (article L. 541-9-4 du Code de l’environnement).
- Le droit à la réparation (directive (UE) 2024/1799) est une règle distincte, qui porte sur la garantie et l’obligation de réparer du fabricant, pas sur l’affichage avant l’achat.
- Les obligations de pièces détachées des règlements d’écoconception visent les fabricants, importateurs et mandataires, pas les vendeurs ; pour les smartphones, sept ans après la fin de la mise sur le marché (règlement (UE) 2023/1670).
